Current Feed ContentSanyang sand miner jailedThursday, October 16, 2008 One Edrissa Jatta, the operator of the Sanyang Sand Mining Company, was, on Wednesday, sentenced to three months with hard labour by Magistrate Pa Harry Jammeh of the Brikama Magistrates Court. According to the particulars of the case, Edrissa Jatta on 10th of October, 2008, at the Sanyang Sand Mining Company, stole ten litres of gas oil from the said company. When the charge sheet was read to him, Mr Jatta pleaded guilty. According to facts of the case, Mr Jatta was seen and apprehended by one Edrissa Sanyang while trying to hide the fuel. He was later taken to the Sanyang Police Station where he was charged with stealing. Author: by Amadou Sonko Bah 3 fake gold dust dealers sentencedWednesday, September 24, 2008 Magistrate Pa Harry Jammeh of the Brikama Magistrates Court, yesterday, sentenced and fined three youths in the persons of Abbas Jarju, Ebrima-Sori Camara and Essa Ndafe to pay the sum of D10, 000, each, in default to serve two years imprisonment after they pleaded guilty to charges of dealing in fake gold dust, which contravenes Section 344 Cap 10 Volume 3 of the Criminal Procedure Code of The Gambia. The defence counsel of the convicts, Lawyer Camara, made a lengthy plea of mitigation for his clients and urged the court not to inflict custodial sentences on the convicts, considering the fact that they had been in remand for some time. “I will finally urge this honourable court to please impose a pecuniary fine on them,” he pleaded. "When I tried with my other hand, he did the same," Saho said. He further told the court that Mr Bah then attempted to hit him with the stick and he (Saho) took it from him and they were both pulling at it until one Ensa came and separated them, but Mr Bah hit him (Mr Saho) with the stick on the head, giving him injuries. Lamin K Mboge represented the complainant while Corporal 1320 Bojang represented the IGP. Author: by Amadou Jallow Youth convicted for stealing bag of riceFriday, May 23, 2008 Magistrate Ayoub John Njie of the Brikama Magistrates’ Court on Wednesday convicted and sentenced one Lamin Faye to three years imprisonment, with hard labor, after being found guilty of stealing a bag of rice from the shop of one Alfusainey Jallow, valued at D825.00. In his plea for mitigation, Lamin Faye begged the court to tamper justice with mercy, stating that the act came as a mistake to him. Handing down his judgement, Magistrate Njie put it to Mr Faye that the act was not a mistake. He told him that he could not steal a bag of rice and call it a mistake. Magistrate Njie then went on to impose a three months sentence on Lamin Faye, with hard labor. Author: by Amadou Jallow Youth convicted on multiple chargesThursday, May 15, 2008 Magistrate Ayoub John Njie of the Brikama magistrates Court on Monday convicted and sentenced a youth from Sanyang Village to three years imprisonment, after admitting guilt on four of the five counts of felony, theft, attempted murder and unlawful escape from lawful custody. However, Mr Saidy has pleaded not guilty on the third count of stealing D3,000 cash, leading to the adjournment of the trial. Narrating the facts before the court, police prosecutor Sub-Inspector Saine said the convict broke into the shop of one Abdoulie Ceesay at Sanyang Village and stole a mobile phone. He said the accused was later apprehended and taken to the police station, where he was locked in a cell. Sub-Inspector Saine told the court that the convict later took a rope in an attempt to strangulate himself, adding that this was subsequently thwarted after the police noticed it. He said Abdou later managed to escape from the police through a small window, but was later caught by the police at Sibanor Village in Foni. In his plea for mitigation, Abdou begged the court to exercise mercy, as he was a first time offender. He also told the court that he would not repeat the act again. But the presiding Magistrate Njie went on to slam a tough sentence on him. Author: by Amadou Jallow Cruel father sentenced![]() Wednesday, May 07, 2008 Senior Magistrate EF M’Bai of the Brikama Magistrates Court on Monday sentenced one Musa Sanyang, a native of Lamin Village, for unlawfully hitting his seven-year old son with a stick on the head, to a jail term of nine months with hard labour. Narrating the facts before the court, police prosecutor, Cpl 413 Sanyang, said on the 15 of April 2008, the victim (name withheld) was playing with his friend at home when they cut some mango fruits from a tree in the compound. According to the police prosecutor, when Musa saw them, he ran after them. The prosecutor noted that when the convict got hold of his son, he took a stick and hit him, causing him injuries on the head, and also causing fracture on the young boys left arm. Prosecutor 413 Sanyang told the Court that the matter was then reported to the Yundum Police station by the convict’s own wife, Ramatoulie Gibba. "The victim was then rushed to Banjulinding health centre where he was treated and discharged," Sanyang said. He expounded that after the boy was discharged from the health centre, a medical certificate was issued to him and a photograph of the boy’s head was also taken. Sanyang then tendered both the medical certificate and the photograph as exhibits, which were granted by Magistrate M’Bai and there was no objection from the father, Musa Sanyang. Corporal Sanyang concluded that the convict was then arrested by the police and later charged for the offence committed. In his mitigation, Musa Sanyang noted that he had five children who were all depending on him alone for their survival; education and health. He urged the court to pardon him. Handing down his verdict, Senior Magistrate M’Bai told the convict that he had taken into account that he (the convict) had pleaded guilty to the offence, adding that he (M’Bai) was well aware of the fact that the victim concerned was the convict’s own flesh and blood, who was only seven years old. Senior Magistrate M’Bai further told the convict that he had taken note of the fact that he (Mr Sanyang) had informed the court that he was taking care of a big family. "But I did not hear you make one statement in your mitigation that you regretted your action or that you would never do it again. I did not hear you say even the word "Sorry". M’Bai noted. He told the convict that the fact that he was the head of his family, taking care of them, did not mean that the court would deem it fitting not to pass a custodial sentence on him. "It is true that the victim is your son but even animals should not be treated in such a way, much more your own blood", he told Mr Sanyang. He further put it to him (Mr Sanyang) that he should protect his son and not to harm him. "I would not hesitate to say that your action has shown to me that you are a pure heinous man," M’Bai concluded. He then convicted and sentenced Musa Sanyang to Nine months imprisonment with hard labour, without an option of a fine. Author: by Amadou Jallow Thieving guards jailedWednesday, April 30, 2008 Senior Magistrate EF M’Bai of the Brikama Magistrate court on Monday convicted and sentenced two Saloum security guards to six months imprisonment each without an option of a fine The duo Bubacarr Saine and Dan M’Bai pleaded guilty for stealing twenty litres of gas oil at their guard post at Bajagar Village valued D560 being the property of Kharafi Company. According to the police prosecutor Corporal 752 Sarr ,the duo were on April 13th 2008 arrested at their guard post at Bajagar for allegedly stealing the said twenty litres of gas oil. According to corporal Sarr. The two confessed stealing the gas oil during their interrogation and subsequently they were taken to Sibanorr police station where they were cautioned and charged. In their plea for mitigation, the two Bubacarr Saine and Dan M’Bai begged the court to exercise mercy on them saying that they will never repeat the act in living memory. Handing down his verdict, Magistrate M’Bai put it to the two that they are paid on salaries to safe guard the company’s properties and not to steal . He noted that the act was as a result of greed and they lack honour for themselves. Senior Magistrate M’Bai then convicted and sentenced the two to Six months’ imprisonment each with hard labour.
