Current Feed ContentMagistrate cautions prosecutorsMonday, October 06, 2008 Principal Magistrate Buba Jawo of the Kanifing court on Monday pointed fingers at police prosecutors saying that they should be fully prepared to pursue their cases before they appear in court, so as to avoid wasting the court’s time. Principal Magistrate Buba Jawo made these remarks on Monday while responding to an application made by Police Prosecutor Sergeant Touray for an adjournment in the ongoing trial involving two accused persons, Babou Jobe and Muhammd Lamin Ceesay, on the grounds that he wanted to substitute the initial charge preferred against the accused persons with a fresh one. The two accused persons had been granted bail at an earlier sitting but had been detained pending investigations. The counsel for the accused persons, Lawyer Jobarteh, objected to the prosecutor’s application. Principal Magistrate Buba Jawo, however, granted the prosecutions application for an adjournment but cautioned “coming to court means being ready for cases”. He warned that his court would no longer entertain such actions. Author: by Amadou Sonko Bah In Musa Suso’s Case , Defence Application Refused![]() Wednesday, September 17, 2008 The Banjul Magistrates’ Court, presided over by Magistrate Kayode, yesterday refused the application by the defence counsel Lamin Jobarteh following a ruling delivered on the said application. Lawyer Lamin Jorbarteh earlier on made an application for the court to order the prosecution to provide them with all the information necessary to the case to enable them prepare their defence. The application was objected to by the prosecution on the grounds that those are the documents the prosecution intends to use against the accused. Superintendent Badjie further argued that the defence application is meant to disarm the prosecution. Defence counsel, Lamin Jobarteh later applied for an adjournment of the case, as they wish to appeal against the ruling which to him is a denial of their constitutional rights. He said the application for an adjournment is to enable the defence to file an appeal and for a stay of proceedings at the High Court. He also applied for a copy of the ruling to be made available to them. In response, police prosecutor Superintendent Badjie, said there is no application for a stay of proceedings as at now at the High Court. He said the defence counsel only informed the court of their intention to appeal against the Magistrates’ Court ruling. He added that he had a witness in court and he is prepared to proceed with his witness. But the defence counsel application for an adjournment was ultimately granted. Defence Counsel Cham-Chongan filed this application on Wednesday, when the trial resumed before Justice Yamoa of the Criminal Division of the High Court, Banjul. State Counsel Merley Woods raise no objection. The presiding judge granted the application and adjourned the case to July 9, for continuation of the proceedings. Hamadi Sowe is being tried for alleged concealment of the 21st March 2006 foiled coup, plotted and led by the ex-chief of Defence Staff of the Gambia Armed Forces, Col Ndure Cham. Saliu US Embassy launches new websiteWednesday, May 07, 2008 The US Embassy in Banjul, last week, launched a new website which is expected to improve customer services, at the Embassy complex on Kairaba Avenue. The reconstruction of a new website is a general requirement of all the US embassies around the world and the re-designed format makes the website more user friendly, with a catalogue of invaluable information. Speaking at the launching ceremony, Wendy A Kennedy, the consular at US Banjul Embassy, said the website would make access to information a lot easier and better helps its users to understand the information material. Ms Kennedy highlighted that the new home page provides news, US citizen services, information on visas, among other relevant issues. She added that the website was designed to the convenience of the its users, with remarkable internet speed connections. For his part, Mr Muhammed M Njie, the assistant diplomacy and cultural affairs officer at the US Embassy, explained that this change was meant to promote better and positive communication between the embassy and the people they serve. Mr Njie pointed out that the home pages, such as the embassy news, contains all the latest headlines from Washington, press releases, information on schedules, holidays and events attended by the ambassador, among others. On the US citizen services page, he stated that this provides information and assistance to US citizens in The Gambia and that the visa page also provides information and guidance on visa applications for immigrant and non-immigrant visas for an easy application process. The new US Embassy website also has the names of cities around the world. According to the embassy, visa applications for both the immigrant and non-immigrant visas can only be done online. Author: by Ebrima Jatta Manlafi Sanyang’s Bail Review Application Rejected![]() Tuesday, March 18, 2008 The application for bail condition review concerning Manlafi Sanyang was on Wednesday rejected by the Banjul Magistrates Court. The accused Manlafi Sanyang, former government vehicles controller at State House, had earlier on applied to the court for a review of the bailed condition granted to him as he is unable to fulfill the condition. Delivering ruling on the application Magistrate Kayode stated that the submission of the defense counsel failed to state how it became impossible to get a Permanent Secretary as surety for the accused person. He held that in a situation where there would be more than 10 Permanent Secretaries serving in the civil service of the Gambia at any given time, how then it was impossible to get a Permanent Secretary. He said the amount of bail shall be fixed with due regard to the circumstance of the case and shall not be excessive. He wondered aloud as to who is better placed to secure the presence of the accused in court if not a senior civil servant, given the circumstance of the present case where the charge before the court is one in which a government property is alleged to have been stolen. It could recalled that the accused, Manlafi Sanyang, has been standing trial for allegedly stealing a pick-up vehicle with registration no. BJL 4591B, being the property of the Gambia government. Tuesday, March 11, 2008 In a press release in The Point newspaper yesterday, the GPU stated that “The Executive Board of The Gambia Press Union would like to seize this opportunity to remind all that only fully paid up members have voting rights.” Thirty one journalists at the Daily Observer completed their membership forms and paid their application fees on the 21st February 2008. These applicants have not heard anything from the GPU about their application. Another GPU congress is only 12 days away. The Daily Observer contacted Mr Madi Ceesay, the chairman of GPU, yesterday. Mr Ceesay said that “the GPU Executive will meet very soon, certainly before the GPU congress” to “consider the applications” and decide on “who can become members” and thus have the power to vote. The question for all media houses and the GPU is this: Once these applicants are approved, will their annual membership be processed on time for them to be allowed to vote at the GPU congress in 12 days time? As it is, they cannot pay their annual membership until their application is approved. When will the GPU Executive approve these applications? One day before the congress? Or in the next two days so that the approved applicants can pay their membership fees and vote at the congress. We also understand that some journalists applied six months ago and have yet to hear from the GPU.Some say their names completely disappeared from the GPU register! What about those whose membership applications are turned down by the GPU Executive? Will they have time to appeal that decision before the GPU congress? Mr Ceesay had this to say yesterday and he insisted that the Daily Observer quote him correctly: “We are mature and responsible people who will give enough time to applicants to become members.” When the Daily Observer added “and to vote at congress”, Mr Ceesay said: “You are putting words in my mouth.” So, here again is the quotation with which Mr Ceesay is happy: “We are mature and responsible people who will give enough time to applicants to become members.” We hope for the sake of the GPU and its members this promise is kept and all are allowed to vote at Congress. Author: DO Malafi begs courtTuesday, March 11, 2008 Lawyer Lamin Camara, the counsel for Supt Manlafi Sanyang, has made an application asking the Banjul Magistrates Court to review the bail condition for his client. In his application yesterday, before Magistrate Kayode, Lawyer Camara said for the accused to get a surety who must be a senior civil servant in the rank of a permanent secretary as a condition “is tactically impossible”. He assured the court that if the bail condition is reviewed, the surety must ensure that the accused is present in court anytime he is needed. Responding to an application by Inspector Yaya Touray to adjourn the case for two weeks, Lawyer Camara objected to the application, saying that there is need to expedite the case against the accused. ”My client is still under detention; therefore, to adjourn the case for a forthnight will not be in his interest,” he submitted. Inspector Yaya Touray had earlier on informed the court that he would like to consolidate the charges against Supt Manlafi Sanyang, Lt Bakary Camara and Dominico Fedeli on the next adjourned date. Source: Wikinews CARNEGIE IN COURTFriday, February 22, 2008 The managing director of Carnegie Minerals the Gambia, yesterday appeared before presiding Judge Na Ceesay Sallah-Wadda at the Banjul High Court for review of his bail condition. Lawyer Menneh, counsel for the accused person, informed the court of his intention to apply for review of the bail conditions of his client. According to Lawyer Menneh his client was unable to meet the condition of bail granted and therefore would urge the court to reduce the conditions so as to enable him to meet the required conditions. “I urge the court’s indulgence to reduce the bail condition to $100,000 by way of deposits to the Registrar of High Court,” he said. Director of Public Prosecution (DPP) Emmanuel Fagbenle did not object to the defence counsel’s application, noting that the issue of reviewing the bail condition touches on the due proceedures. He therefore urged the defence counsel to file a formal application to the court for review of the bail conditions. The defence counsel filed a formal application to that effect, after the court stood down to enable him to make the formal application. The presiding judge Na Ceesay Sallah-Wadda adjourned the case to Monday 25th February for ruling on the bail application. The managing director had appeared before the court last Friday, when the bail condition was set after he had been charged on fourt counts of mineral offences. He is facing three counts of economic crime charges, all contrary to Economic Crime Decree No. 16 and one count of theft contrary to Section 252 of the Criminal Code Laws of The Gambia.
