Current Feed ContentDonkey consolation for complainantWednesday, November 12, 2008 Magistrate Pa Harry Jammeh of the Brikama Magistrates Court last Tuesday compensated one Ndey Jarju with a donkey, a cart and a bicycle, after the court realized that the man who broke into her shop and stole items worth over D17,000 was unable to pay. The magistrate arrived at this decision after the accused - Ebrima Touray of Lamin - told the court that he accepted the charges against him but confessed that he has two wives and five children and could not pay any fine. Magistrate Jammeh said it was unfortunate that the complainant had lost her money and that the accused could not pay. He therefore ordered the accused to surrender his donkey, cart and a bicycle to the complainant even though that does not cover the amount she had lost. He further sentenced the accused to a jail term of six months with hard labor. The magistrate said he had given the accused a light sentence because he is an old man with family, but warned him that if he should commit any crime after his six months, the law would dealt with him accordingly. Author: by Modou Kanteh Oley Sey Confessed Receiving D200,000, Pw2 Tells Court![]() Friday, September 05, 2008 Police Officer Omar Tunkara, attached to the NIA Investigation Unit, yesterday told the Banjul Magistrates’ Court that the 1staccused, Oley Sey, had confessed to being given the sum of D200, 000 by her co-accused Abdou Rahman Bah. Testifying, the prosecution witness Omar Tunkara stated that on 7thAugust 2008 he was on duty when he was asked by the officer commanding the investigation unit to obtain cautionary statements from the accused persons. He said prior to obtaining the statements he interrogated the accused persons, adding that it was during the interrogation that the 2ndaccused Abdou Rahman Bah told him that he had given the 1staccused, Oley Sey, the sum of D400,000 out of the D500,000 that was given to him by the president through the Department of State for Basic and Secondary Education for the completion of James Junkung Jammeh Memorial Nursery School situated at Abuko, and he (Rahman) retained the D100,000. Further testifying, the witness told the court that he was also told by the 2ndaccused Abdou Rahman Bah that he had spent D20, 000 out of the D100, 000 that was retained by him. He said the balance of D80,000 was later recovered from the accused Abdou Rahman Bah, stating that the 2ndaccused’s brother brought in the D20,000 in order to complete the D100,000 that was retained by the accused person. He added that in total D100, 000 was recovered from the 2ndaccused Abdou Rahman Bah. He said when the 1staccused, Oley Sey, was interrogated she denied being given D400,000 by the 2ndaccused , but confessed to having been given the sum of D200,000 by her co-accused Abdou Rahman Bah for safe keeping. He said the sum of D200,000 was recovered from the 1staccused Oley Sey. He said later he obtained the cautionary statements from the accused persons at the NIA Investigation Unit in the presence of an independent witness, one Babucarr Khan. It will be recalled that the accused persons were alleged to have conspired and stolen the sum of D500,000 being the money donated by President Jammeh to Sulayman Junkung Jammeh nursery School situated at Abuko. The case was presided by Magistrate Lamin George. The hearing continues today. Author: By Modou Sanyang Source: Picture: Oley Sey startling confession!Wednesday, July 02, 2008 A sixteen-year old girl (name withheld), who was said to have been allegedly impregnated by her 35-year old teacher, identified as one Muhammad, at Kombo Kerewan Upper Basic School, Kombo North, has stated that she was not forced by her teacher to have carnal knowledge of her. The young girl made this startling revelation, on Monday, before Senior Magistrate EF M’Bai of the Brikama Magistrates Court. According to her, the first day she entered the accused person’s house, she herself followed him into his bedroom to have “intercourse” with him. She further told the court that the day she went to the accused person’s house, she had just come from Banjulinding Health Centre, where she went to get medicine for her eyes, which were hurting. She said on the way, she met the accused who stopped her and asked what the matter was. Continuing her narration, she said she told the accused that her eyes were paining her and she had gone to find medicine, but had been unsuccessful. She further went on that the accused then bought some paracetamol tablets for her and later asked her to go with him to one of his friend’s house. She asserted that while they were in the house, the accused person was fingering a computer and she also had interest in the computer, which led her to go and sit beside the accused person. According to her, some minutes later, the accused person went into the bedroom and she followed suit. “That was the first day I had intercourse with the accused,” the young girl confessed to the court. A week later, the young girl continued, there was a sporting activity at the school and when the accused person met her, he asked her to go with him to his house, since she (the girl) was lonely. She added that in March this year, while she was at school, she started vomiting and when the accused asked her what was the matter, she told him that she was sick. According to her, the accused then took her to the health centre, where the result of the check indicated that she was pregnant. “I did not want to reveal this to my aunt at first, but a neighbour told her later on,” she concluded. The accused has admitted having intercourse with the young girl, but continues to maintain that this was in February, when the girl had already turned 16 (the legal age of consent). The case is now adjourned to July 7, for continuation of the proceedings. Police prosecutor, Sergeant 119 Camara represented the IGP in the case. Author: by Amadou Jallow Babylon’s fake alkalo confesses!Wednesday, April 23, 2008 As proceedings into the ongoing Babylon attack case continue before Magistrate EF M’Bai of Brikama Magistrates Court, more startling revelations continued to stormed the court. Lamin Jarju, the fake Alkalo of Babylon village in Kombo North, yesterday confessed that he is not the Alkalo of Babylon village but he has the stamp of an Alkalo, he do give lands to people at free of charge and do collect rates and paid to the Area Council. Mr Lamin Jarju made this revelations whilst responding to cross examination questions posed to him by Antouman Gaye, lead defence counsel at the trial. Antouman Gaye asked Lamin Jarju to read loud in the open court a document bearing an Alkalo stamp date 25th January 2007 purportedly giving ownership of a piece of land to somebody. Mr Lamin Jarju complied and accepted that he issued the document with his stamp, but was quick to say, he inherited Babylon from his ancestors, associating himself with the graves in the bush as his ancestors. Still responding to the defence counsel’s questions, Lamin Jarju admitted that Eric Tunde Janneh, former chief of Kombo North sent him to the Campama Medical Centre but denied that he was sent to Mile 2 by the said former head chief adding, “I was once taken to the NIA for questions. I am not the biggest trouble maker in the whole of The Gambia”. Mr Jarju further admitted been once a member of the Gambia Armed Forces (GAF) but denied been dismissed due to his troublesome nature. Lamin Jarju also denied that he and his body guards are operating like ‘a state in state’ at Babylon by demolishing leased landed properties, houses, cashew trees, fences and other valuable properties of people such as Mr Abdou Jobe, former managing director of NAWEC, Amadou Taal, former Permanent Secretary at the Department of State for Local Government and lands, Mohamed Sawaneh among others who had their lands leased by the government of The Gambia. Mr Jarjue further denied knowing one Sheikh Sarr alias Tony Blair but later admitted knowing him as his friend. He said he knew names such as Nuha Saidykhan, Demba Fatty, Masanneh Ceesay, Seedy Fofana, Hena, Lamin Badji among others whom he described as either his associates or relations. When put to him that at the last sitting he told the court that he identified Yaya Suwareh and Karafa Jawara, among the last six accused arrested, Lamin Jarjue denied identifying Yaya Suwareh but admitted identifying Karafa Jawara who is said to be in Brufut village Kombo North at the time of the Babylon incident. ASP Camara, police prosecutor at that juncture applied to add additional two counts on the charge sheet making it a total of 5 counts. The application was granted by Senior Magistrate EF MB’ai. These latest counts included count 4, criminal trespass and count 5, willful damage to property all contrary to the Criminal Code Cap 10 volume III laws of The Gambia. However, when the additional charges were read to the accused persons, they pleaded not guilty saying Babylon did not exist and the place is their farm land. The case continues today.
